In this Privacy Statement “we” or “Netlogix” refers to the Netlogix group of companies (being, Netlogix Limited, Netlogix Supply Chain Solutions Limited, Netlogix Warehousing Limited and Netlogix Australia Pty Limited).

This Privacy Statement explains how we handle the information we collect, including personal information, and how we comply with the requirements of applicable privacy laws, including the Privacy Act 2020 (NZ) and the Australian Privacy Act 1988 (Cth).

This Privacy Statement may be amended from time to time and the most up to date version will be published on this webpage.

2. Collection and Use of Personal Information

Personal Information is any information about an identifiable individual. This Privacy Statement is not applicable to data collected about companies.

We collect and hold personal information relating to our actual and prospective carriers (including drivers) and shipping customers, consumers, suppliers, employees, job applicants, contractors and other individuals.

The types of personal information we may collect and hold includes but is not limited to:

  • contact details (including name, mailing and/or physical address, delivery address, e-mail addresses, phone numbers, emergency contact details);
  • payment details (including credit and billing information);
  • professional details (e.g. job and career history, educational background, names of referees);
  • images and contact details (and security camera footage of drivers to our x-dock and storage facilities) of visitors to our physical sites;
  • general user information and location-based data such as internet protocol addresses, browser type and internet service provider details and other technical information collected when you visit our websites;
  • real-time precise location and GPS data of a carrier’s driver when the driver is using our Customer and/or Carrier Portals;

We collect, hold and use personal information for the following purposes:

  • The performance of contracts/agreements;
  • To provide our customers with the services they have requested;
  • To communicate with our customers, carriers and suppliers about quotations, shipments, deliveries and invoicing;
  • To settle payments with our suppliers and carriers for the services provided;
  • For assessment and acceptance of a prospective customer, shipper, supplier or business partner.
  • For billing and accounting purposes;
  • To enable us to answer our customers’ and suppliers’ enquiries;
  • For verifying customers’ and suppliers’ identity for security purposes;
  • For relationship management and marketing our services;
  • To streamline and manage our services through our Customer and/or Carrier Portals;
  • To make our website and the Customer and/or Carrier Portals more user friendly and relevant to the needs of users;
  • To enable real-time feedback on the status of customer orders, to improve predictive software and to provide insight into the cause of differences between planned and actual delivery routes;
  • To communicate with individuals about how to improve our services;
  • In relation to our employees, providing internal services to our staff and seeking qualified candidates;
  • To keep visitors to our physical sites safe;
  • Compliance with mandatory legal obligations;
  • For other purposes relating to our business.

Your personal information will not be used for other purposes unless we obtain your consent to the secondary use, or the secondary use is required or permitted by law.

If you choose not to provide us with personal information which we have requested from you, we may be unable to fulfil any of the above purposes, including providing services to you, responding to your requests, paying your invoices or processing your application for employment.

3. How we collect personal information

Directly: We collect personal information directly from individuals in the following ways:

  • when we are establishing a business relationship for the supply or procurement, or the prospective supply or procurement of services;
  • when individuals sign up to use the Customer and/or Carrier Portals;
  • when drivers are using the Customer and/or Carrier Portals while they are performing the services;
  • when individuals visit our offices for business or recruitment purposes;
  • when individuals use or access our website.

Cookies and web beacons: Our website may use cookies or other analytical tools to monitor your browsing.

Personal Information about others: If you submit personal information to us about another individual, you must obtain permission from that individual and take reasonable steps to ensure that that person understands what personal information we will collect and use.

Children: Our websites are not intentionally designed for or directed at children under the age of 16. It is our policy never to knowingly collect or maintain information about anyone under the age of 16.

4. Sharing and Transfer of Personal Information

The Personal Information that we collect is stored on our local servers in New Zealand and Australia, and in “cloud” instances like AWS/Azure/Confluence in Australia.

Transfers within the Netlogix group of companies: The Netlogix group of companies is based in Australia and New Zealand. We may share your Personal Information between entities for administrative purposes and to provide the services to our customers. All Netlogix entities will handle your Personal Information as described in this Privacy Statement.

Sharing with third parties: The personal information that you provide us may be shared with third parties to the extent necessary to carry out and perform the services, complete your requests and where required to disclose that information by law or for safety reasons, with your consent or as otherwise stated in this Privacy Statement. Examples of this might include:

  • Sharing with our service providers: we work with reputable service providers to meet our business needs and perform services for our customers.
  • Sharing with professional providers: we may share your personal information with our professional advisors, including lawyers and insurers.
  • Sharing as required under applicable laws, regulations or professional standards: there may be occasions when courts or other regulatory bodies required us to share personal information with them in accordance with application laws.
  • Sharing in the event of sale or transfer: In the event the Netlogix business is sold, transferred or assigned, disclosure might be necessary for that sale, transfer, merger or assignment, or as a result of the sale, transfer, merger or assignment.
  • Sharing with payment, marketing and recruitment service providers: We may share your personal information with payment, marketing and recruitment service providers.

In some cases, the third parties we share your personal information with may be located outside of New Zealand or Australia including, but not limited to, Singapore, Europe and the United States. In some cases these third parties may not be required by local laws to protect your Personal Information in a way that, overall, provides comparable safeguards to those under New Zealand or Australian law.

5. Security and Retention of Personal Information

Netlogix uses appropriate technical and organizational measures to ensure that personal information is well protected from loss, unauthorised access, use, modification, disclosure or misuse. Despite our best efforts, security cannot be guaranteed against all threats. To the best of our ability, access to your personal information is limited to those who need to know it. Those individuals who have access to the data are required to maintain the confidentiality of the information.

Our website does not provide facilities for the secure transmission of information across the internet. Users should be aware that there are inherent risks transmitting information across the internet.

We retain personal information to provide our services, stay in contact with you and to comply with applicable laws and regulations. We retain personal information as long as necessary for the processing purposes for which the information was collected, and any other permissible, related purpose.

6. Our Customer and Carrier Portal

The Customer and Carrier Portals are used as part of our customer offerings and are designed to provide insight into the progress of freight management from ordering capacity for the movement of cargo to tracking it once it has been collected site until it is delivered to the designated destination. It is used by both Carriers (including drivers) and Customers.

The personal information we may collect via the Customer and/or Carrier Portals includes but is not limited to:

  • Contact details (names, addresses, email addresses);
  • Other personal information a driver may choose to input into the portal;
  • Information that a Carrier inputs into the applications about a driver, if a driver is employed or engaged by that Carrier;
  • Real-time precise geographic location data of the driver while using the portal;
  • Photo/document uploads (e.g. proof of delivery).

The Customer and/or Carrier Portals also collects information about the behaviour of the driver and the driver’s use of the vehicle including vehicle speed, route of the vehicle, acceleration, braking or lateral movements, impacts to the vehicle, refuelling of the vehicle and hours during which the vehicle is in use.

To gather this information the Customer and/or Carrier Portals may request access to the device’s camera, GPS and camera roll. Users are able to change their permissions access via their device’s settings.

The information collected via the Carrier and/or Customer Portals are used to provide the services to customers and for the purposes set out in this Privacy Statement.

7. Your Privacy Rights

Where we hold personal information about you:

  • you have the right to access that information where it can be readily retrieved, except in the limited circumstances in which it is permitted for us to withhold this information; and
  • if that information is incorrect, you may ask that we correct it.

You can make requests to access personal information by emailing us at the email addresses below.  In most instances, we will require you to provide some form of identification (such as a driver’s licence or passport) so we can verify that you are the person to whom the information relates.

We keep our Privacy Statement under regular review, and we reserve the right to modify this Privacy Statement from time to time to reflect changes in the law, our use of information and other business activities and the services that we provide. If the changes do not disadvantage you, we may notify you of the changes by publishing an updated version of this Privacy Statement on our website and it is your responsibility to review the current version of this Privacy Statement when you use our website.

If we make any other changes, we will take additional steps to bring the changes to your attention, such as by providing you with notice of our updated Privacy Statement with a notice on our website, online customer or carrier portal or by other direct communication, such as email.
